These terms and conditions of sale are concluded on one hand by the company Anatayha with a capital whose registered office is located at Dordogne, France, and managing the website artisans.hanka.fr and, on the other hand, by any natural or legal person wishing to make a purchase via the website artisans.hanka.fr hereinafter referred to as "the buyer".

Article 1. Purpose

These terms and conditions of sale aim to define the contractual relationships between ANATAYHA CONSULTANT and the buyer and the conditions applicable to any purchase made through the website www.anatayha.com. The acquisition of a product or service through this site implies unconditional acceptance by the buyer of these terms and conditions of sale, which the buyer acknowledges having been aware of prior to their order. Before any transaction, the buyer declares on one hand that the purchase of products or services on the site www.anatayha.com is not directly related to his professional activity and is limited to strictly personal use and on the other hand to have full legal capacity, allowing them to commit under these general conditions of sales.

ANATAYHA CONSULTANT reserves the right to modify these terms of sales at any time in order to comply with any new regulation or to improve the use of its site. Therefore, the applicable conditions will be those in force on the date of the order by the buyer.

Article 2. Products

The products offered are those listed on the artisans.hanka.fr site of the company ANATAYHA CONSULTANT within the limits of available stocks. The company ANATAYHA CONSULTANT reserves the right to modify the product range at any time. Each product is presented on the website in a description summarizing its main technical characteristics (capacity, use, composition...). Each Service is presented on the website with a description summarizing the main characteristics specifying it, the rate. The photographs are as faithful as possible but do not bind the Seller. The sale of products presented on the site artisans.hanka.fr is intended for all buyers residing in countries that fully allow the entry of these products into their territory.

Article 3. Rates

The prices listed on the internet product sheets of the catalog or the services offered are prices in Euros (€) all taxes included (TTC) taking into account the non-applicable VAT. Any change in the VAT rate may be reflected in the price of the products. The company ANATAYHA CONSULTANT reserves the right to modify its prices at any time, it being however understood that the price listed in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery costs, charged in addition to the price of the products purchased according to the total amount of the order. In mainland France, for any order equal to or greater than 70 euros TTC, shipping costs are offered; for any order less than 70 euros TTC, a flat fee for participation in shipping costs will be charged to the buyer at a minimum amount of 7 euros TTC.

Article 4. Order and Payment Terms

The company ANATAYHA CONSULTANT offers the buyer to order and pay for its products in several steps, with 3 payment options to choose from:

  • Payment by check: the buyer selects the products they wish to order in the "basket", modifies if necessary (quantities, references...), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the payment method of their choice: "Payment by check". Finally, the last step offers them to review all the information, take note and accept these general conditions of sale as accepted by the validation of the purchase, then invites them to validate their order by clicking on the "Confirm my order" button. This last click forms the definitive conclusion of the contract. Upon validation, the buyer receives an order form confirming the registration of their order. To finalize their payment and trigger the processing of their order, the buyer must print this order form, accompanied by their check made out to "ANATAYHA" at the following mentioned address. No cash payment should be sent. Only checks issued by a French bank will be accepted. Once the check is received, the order will be processed and the buyer will be informed by email. The company ANATAYHA will ship the products at the earliest 2 business days after cashing the check corresponding to the order, subject to provisions, for a service a response as soon as 1 business day is given by email or phone.

  • Payment by bank transfer: the buyer selects the products they wish to order in the "basket", modifies if necessary (quantities, references...), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the payment method of their choice: "Payment by transfer". Finally, the last step offers them to review all the information, take note and accept these general conditions of sale by checking the corresponding box, then invites them to validate their order by clicking on the "Confirm my order" button. This last click forms the definitive conclusion of the contract. Upon validation, the buyer receives an order form confirming the registration of their order. To finalize their payment and trigger the processing of their order, the buyer must contact their bank to make the transfer corresponding to the amount of their order to the bank account of ANATAYHA CONSULTANT, whose details are communicated to the buyer. Upon receipt of the transfer, the order will be processed and the buyer will be informed by e-mail. The company ANATAYHA CONSULTANT will ship the products at the earliest 2 business days after receipt of the transfer corresponding to the order, subject to provisions. For a service a response as soon as 1 business day is given by email or phone.

  • Secure payment by STRIPE or credit card (via the STRIPE system): the buyer selects the products they wish to order in the "basket", modifies if necessary (quantities, references...), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the payment method of their choice: "Payment by Stripe". The next step offers them to review all the information, take note and accept these general conditions of sale by checking the corresponding box, then invites them to validate their order by clicking on the "Confirm my order" button. Finally, the buyer is redirected to the secure Stripe interface to securely enter their Stripe account references or personal blue card. If payment is accepted, the order is registered and the contract definitively formed. Payment by Stripe account or by credit card is irrevocable. In case of fraudulent use of it, the buyer may demand the cancellation of the card payment, the amounts paid will then be re-credited or returned. The responsibility of a credit card holder is not engaged if the contested payment has been proven to be fraudulently made, remotely, without physical use of their card. To obtain reimbursement of the fraudulent debit and any bank fees that the operation may have incurred, the cardholder must contest, in writing, the debit with their bank, within 70 days of the operation, or 120 days if the contract binding them to it provides for it. The amounts debited are refunded by the bank within a maximum period of one month after receipt of the written dispute filed by the holder. No costs for the restitution of the sums can be charged to the holder.

The confirmation of an order entails acceptance of these terms of sale, the acknowledgment of having perfect knowledge of them and the waiver of its own purchase conditions. All the data provided and the recorded confirmation will prove the transaction. If the buyer has an email address and if they have provided it on their order form, the company ANATAYHA CONSULTANT will communicate by email the confirmation of the registration of their order.

Article 5. Retention of title

The company ANATAYHA CONSULTANT retains full and complete ownership of the products sold until the perfect collection of the price, in principal, fees and taxes included. But also the full copyright on all documents transmitted during the services offered.

Article 6. Withdrawal

In accordance with Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their ordered product to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty, except for return costs.

Article 7. Delivery

Deliveries are made to the address indicated on the order form which can only be in the agreed geographical area. Orders are made by La Poste via COLISSIMO, delivery service with tracking, delivery without signature. Delivery times are given as an indication only; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed. The company ANATAYHA CONSULTANT can provide the buyer by email the tracking number of their package. The buyer is delivered to their home by their postman. In the absence of the buyer, they will receive a notice of passage of their postman, which allows them to withdraw the ordered products at the nearest post office, for a period indicated by the postal services. The risks related to transportation are the responsibility of the purchaser from the moment the articles leave the premises of the company ANATAYHA CONSULTANT. The buyer is required to check in the presence of the Post Office attendant or the delivery person, the state of the packaging of the goods and its content at the delivery. In case of damage during transport, any protest must be made to the carrier within three days from the delivery.

Article 8. Liability

The company ANATAYHA CONSULTANT, in the process of distance selling, is held only by an obligation of means. Its responsibility cannot be engaged for damage resulting from the use of the Internet network such as data loss, intrusion, virus, service break, or other involuntary problems.

Article 9. Intellectual Property

All elements of the site artisans.hanka.fr are and remain the intellectual and exclusive property of the company ANATAYHA CONSULTANT. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of photo, logo, visual or text.

Article 10. Personal Data

The company ANATAYHA CONSULTANT commits to preserving the confidentiality of the information provided by the buyer, which he would be required to transmit for the use of certain services. Any information concerning him is subject to the provisions of the law n° 78-17 of January 6, 1978. As such, the Internet user has the right to access, modify, and delete information concerning him. Article 12. Dispute Resolution

These conditions of distance selling are subject to French law. For all disputes or litigation, the competent Tribunal will be sought.
